Notice: The laws change from State to State however in some states, the defaulted tenant has the legal right to cure the account thus canceling the auction up until the cash payment is received from the winning bidder.
Additional Terms: This is a public lien sale conducted pursuant to A.R.S. § 33-1704. All property is sold AS-IS, WHERE-IS, with no warranties or guarantees regarding condition, quantity, quality, or value. All sales are final. This auction is WITH RESERVE. The storage facility reserves the right to reject any bid that does not meet the established reserve. The storage facility/operator also reserves the right, to the extent permitted by applicable law and the auction platform, to bid on the property, including by credit bid up to the amount owed under the rental agreement. The winning bidder must make payment in full and contact the facility within 24 hours after the auction closes. The unit must be completely emptied and all property removed within 48 hours after payment unless other arrangements are approved by management. The winning bidder is responsible for removing all contents from the unit, including trash and unwanted items. No items may be left on the facility property or placed in facility dumpsters. Personal documents, photographs, identification, financial records, and other personal or protected items discovered in the unit must be turned over to facility management and may not be retained or sold. The facility reserves the right to cancel the auction at any time prior to completion of the sale if the tenant satisfies the lien or as otherwise permitted by Arizona law. Failure of the winning bidder to pay for or timely remove the contents may result in forfeiture of the sale and any other remedies permitted by the auction platform and applicable law.
