Notice: The laws change from State to State however in some states, the defaulted tenant has the legal right to cure the account thus canceling the auction up until the cash payment is received from the winning bidder.
Additional Terms: SELF STORAGE AUCTION RULES AND BIDDER AGREEMENT -Payment- All payments must be made in cash or credit card at the conclusion of the auction. All items are sold “as-is” with no representations or warranties. Buyer has 24 hours to contact the storage facility and arrange payment. A $200 clean out deposit will be collected in addition to the payment amount. -Possession- Buyer is required to take possession of the unit within the same 24 hours of the conclusion of the auction. Possession occurs when the buyer places their lock on the unit, at which point the 48-hour clean-out window begins. -Bidder requirements- Bidder must be 18+ years old -Inspection-. Photographs taken and posted with the auction are the only inspection offered. -Tenant right of redemption- All sales are subject to the right of the tenant of the unit to redeem the property any time prior to completion of payment (see item 1). -Vehicles, trailers, boats and outboard motors- All sales of these items are subject to the rights of owners to redeem the property immediately prior to the gavel falling. The facility makes no representations as to any ability of purchaser to acquire legal title to any such item purchased at the auction sale. Unless the newspaper notice advertising the sale contains notice of a vehicle, trailer, boat or outboard motor in the unit, any such item found in the unit is deemed NOT included in the sale and does not transfer, and must remain in the unit after the sale. -Firearms or illicit substances- Any firearms or illicit substances discovered must be turned over to law enforcement or handled per applicable law. The facility is not liable for legal violations related to items found within the unit. -Securing unit after auction- The high bidder must immediately put his lock on the unit. The facility reserves the right to overlock the unit until payment is received. Facility is not responsible for items taken from the unit after the conclusion of the auction. -Cleaning out unit- Buyer is granted a 48-hour clean out window to empty and clean the unit. All units must be left “broom” clean with all items removed (subject to paragraph 7 above) no later than 48 hours after arranging payment to the facility. The clean out deposit will be refunded upon inspection, provided the unit is clean and no prohibited items are left behind. There is no dumpster on the property and trash is not to be left on or near the property. Any items left behind will VOID the return of the deposit. Failure of buyer to abide by this or any other sale term will result in denial of future bidding rights. Upon purchase the buyer becomes the owner of all of the unit contents; it is the buyer’s legal duty to properly dispose of all items warranting disposal, including any records containing sensitive personal information. -Abandonment- Any items not removed at the end of the clean out will be deemed abandoned, will no longer be the property of the high bidder and may be discarded, donated, or sold with all proceeds going to the facility owner, and any deposit will be retained by the facility owner. -Rejection of bids/withdrawal of property- This facility reserves the right to place a minimum bid on any auction item or unit or reject any bid. All sales are subject to the right of the facility to pull all or part of the property from the sale of the item, batch, or unit for any reason. -Sales tax- Sales tax will be collected on the sale price unless no tax is due (such as in the sale of a vehicle or boat, or when the buyer provides a lawful exemption or resale certificate on state comptroller forms.) -Personal items- Please return. All buyers are requested to contact the facility and return any items that may later be found which may be of a personal nature (such as scrapbooks, pictures, marriage certificates, etc.) -Other rules- Any other rules as announced at the auction. If the auction is online, all rules noted as applicable on the auction website also apply. -Legal- In exchange for being allowed to view and bid at this auction, the undersigned, to the maximum extent permitted by law, releases any auctioneer, the property owner, its manager, agents, employees, officers, shareholders and directors from any and all claims, liabilities, causes of action or damages of any type arising in any way out of the use or entry onto the property or the auction.
