Notice: The laws change from State to State however in some states, the defaulted tenant has the legal right to cure the account thus canceling the auction up until the cash payment is received from the winning bidder.
Additional Terms: This is a cash sale only. There is a 10% buyers premium added to the winning price that will be collected by this platform. It will be your responsibility to contact the facility immediately after you win this bid to make arrangements to pay for and pick up the unit. You will receive a unique redemption code that only you and manager will have. The auction is for the entire contents of the unit and it must be completely cleaned out. The manager will collect a $100 cleaning deposit that will be refunded back to you after you clean out the entire unit within the specified time and date. If you are resale you should bring a copy of your resale certificate in with you so the management can waive your sales tax. If you do not have a resale certificate then you will be charged 8.75% for your sales tax. This will be collected by American Auctioneers after the auction closes via telephone and credit card. The bid price and refundable cleaning deposit. Please broom sweep the units out when cleaning. Access to the unit will be only during office hours. Please do not smoke on the property or use the dumpsters. After you have cleaned out your unit you will coordinate with the manager to return your $100 cleaning deposit. 1. AUCTION DEPOSIT RECEIPT: Winning bidder must contact the facility same day as auction. Upon receiving winning notification, Winning Bidder is to call the office at 951 397 2262 and confirm the day and time to pay and remove all items in the unit per terms of sale. A. RELEASE OF OWNER’S LIABILITY FOR BODILY INJURY: Owner, Owner’s agents and employees shall not be liable to Winning Bidder, invitees, employees, or guests for injury or death as a result of the use of the Space or the Facility, even if such injury is caused by the active or passive acts or omissions or negligence of the Owner, Owner's agents, or employees. B. REMOVAL OF CONTENTS: Winning bidder must pay the $100 Cleaning Deposit and Winning Bid Amount in full before gaining access to the storage unit. All items in the storage unit must be removed. The storage unit must be clean and verified by the property manager in order for the deposit to be returned. Use of the property dumpster or surrounding area is strictly prohibited and will result in forfeit of deposit. Access is between ( 8am and 6pm) on the dates agreed upon and listed in Section 1D of the Auction Deposit Receipt. Winning Bidder is to notify the property manager when the unit has been cleaned out so the inspection can commence. C. PAYMENT AND DEPOSIT: Payment must be in cash. Deposit payment and Winning Bid amount are to be two separate payments. A deposit paid in cash will only be returned, if manager's inspection is passed, to the Winning Bidder with matching ID provided in the email with the Winning Bidder's confirmation number.
