Notice: The laws change from State to State however in some states, the defaulted tenant has the legal right to cure the account thus canceling the auction up until the cash payment is received from the winning bidder.
Additional Terms: Rules & Regulations 1. This sale is being held pursuant to the Civil Code of this state. 2. Landlord of the property reserves the right to bid on and/or purchase any unit. 3. A Buyer who has the winning bid for one or more storage units will pay one ???cleaning??? deposit of $100.00 cash. A cleaning deposit is collected to insure that all units are cleaned out by the date given. DO NOT USE OUR TRASH AREA to throw away unwanted items and trash. IT MUST BE HAULED AWAY. 4. No buyer is allowed to enter or make contact with anything inside the unit being sold unless otherwise instructed by a site employee. 5. All items will be sold ???as is??? to the highest bidder. 6. All purchases must be paid for in CASH or CREDIT CARD immediately after all units have been sold. Leaving the property prior to payment will result in immediate forfeiture of the unit. Sales tax will be added, collected and reported. Buyers must provide current, original or photocopy of their Re-Sale Permit in lieu of sales tax. 7. Buyers are required to secure purchased units immediately after payment with their own lock. 8. Landlord of the property requests that all personal papers, photographs and any other sentimental property of no value to the buyer, be left with the site employees in terms of good faith. 9. All items must be removed from the unit by 5pm the day following the sale unless prior arrangements have been made with the site employees for additional time. A buyer cannot rent the purchased unit. 10. Buyer attends the Sale at his or her own risk. Landlord is not responsible for injuries or other losses on the premises. 11. The landlord reserves the right to void the sale for any (or all) items until the buyer has removed them from the storage unit. If voided, the buyer will receive a refund for the full purchase amount including any taxes paid. 12. No recording devices of any kind may be used at the facility on the date of the Sale unless authorized by the landlord. 13. No one under the age of 18 is allowed to attend the Sale. 14. No pets or smoking allowed on the premises.
